1. Acceptance of Terms

By downloading, accessing, or using AgovFit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

AgovFit is a fitness application that provides workout tracking, exercise routines, AI-powered coaching, and related fitness features. Some features require a paid subscription.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Subscription Terms

4.1 Subscription Plans

AgovFit offers the following subscription options:

  • Monthly subscription: Billed monthly
  • Yearly subscription: Billed annually

4.2 Billing and Payment

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase
  • Prices are displayed in your local currency and may vary by region
  • Prices are subject to change with notice

4.3 Auto-Renewal

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
  • You can manage and cancel your subscription in your device's account settings (App Store or Google Play)

4.4 Free Trial

  • If offered, any unused portion of a free trial will be forfeited when you purchase a subscription
  • Free trials are limited to one per Apple ID or Google account

4.5 Refunds

  • Refunds are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies
  • Contact Apple or Google directly to request a refund

5. User Content

5.1 Your Content

You retain ownership of any content you create within the App (workout logs, custom routines, etc.). By using the App, you grant us a license to store and process this content to provide the Service.

5.2 Prohibited Content

You agree not to upload or transmit content that:

  • Is illegal, harmful, or offensive
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Violates any applicable laws

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Share your account credentials with others
  • Use automated systems to access the App

7. Health Disclaimer

IMPORTANT: AgovFit is not a medical application.

  • The App provides general fitness information and is not a substitute for professional medical advice
  • Consult a physician before starting any exercise program
  • We are not responsible for any injuries or health issues resulting from use of the App
  • Stop exercising immediately if you experience pain, dizziness, or discomfort

8. Intellectual Property

  • The App, including its design, features, and content, is owned by Nicolò Calandra
  • You may not copy, modify, distribute, or create derivative works without permission
  • "AgovFit" and associated logos are trademarks of Nicolò Calandra

9. Third-Party Services

The App integrates with third-party services including:

  • Apple HealthKit / Google Fit
  • Firebase (Google)
  • RevenueCat
  • Google AdMob

Your use of these services is subject to their respective terms and privacy policies.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICOLÒ CALANDRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Nicolò Calandra from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Termination

  • You may terminate your account at any time by deleting it within the App
  • We may suspend or terminate your access for violation of these Terms
  • Upon termination, your right to use the App ceases immediately
  • Termination does not automatically cancel active subscriptions; you must cancel separately

14. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be notified via the App or email.

15. Governing Law

These Terms shall be governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy.

16. Severability

If any provision of these Terms is found invalid, the remaining provisions shall continue in effect.
