CineManiac — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CineManiac mobile application ("App"). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.

1 Acceptance of Terms

→ You must accept these Terms during account registration by checking the agreement checkbox in the app.
→ Continued use of the App after any updates to these Terms constitutes acceptance of the revised Terms.

2 Eligibility

→ You must be at least 13 years old to use CineManiac (or the minimum age required by your jurisdiction, which may be higher — for example, 16 in some EU countries).
→ You must provide accurate, current, and complete information when creating your account.

3 Account Responsibilities

→ You are responsible for maintaining the security and confidentiality of your account credentials.
→ Each person may hold only one account.
→ Usernames must be 3–30 characters, alphanumeric and underscores only, no spaces, and must not contain profanity.
→ You must not share your account credentials with others.
→ You are responsible for all activity that occurs under your account.

4 Acceptable Use Policy

The following activities are strictly prohibited:

✕ Profanity or offensive language in usernames (enforced automatically).
✕ Abusive, harassing, threatening, or illegal content in chat messages or any user-generated content.
✕ Spamming friend requests, circle invitations, or event invitations.
✕ Attempting to manipulate, exploit, or artificially inflate the CineManiac Score or shop system.
✕ Scraping, crawling, or automated access to the App or any of its data.
✕ Impersonating other users or misrepresenting your identity.
✕ Circumventing or attempting to bypass any access controls, security measures, or authentication systems.

5 User-Generated Content

The following are considered user-generated content: event chat messages, movie ratings, circle activity posts, poll votes, and movie suggestions.

→ Ownership: You retain ownership of content you create.
→ License: By posting content, you grant CineManiac a non-exclusive, royalty-free licence to display and distribute that content to other users within the App.
→ Removal: We reserve the right to remove any content that violates these Terms or applicable law, without prior notice.

6 Intellectual Property

→ Movie data, images, and metadata are provided by TMDB (The Movie Database) under their terms of use. This product uses the TMDB API but is not endorsed or certified by TMDB.
→ All app design, code, branding, and original assets are the intellectual property of the developer.
→ Shop cosmetic items (borders, text effects, colors) are virtual goods owned by the developer and are licensed to you for use within the App only.

7 Premium Subscription (In-App Purchases)

The CineManiac Premium subscription is managed via RevenueCat through the Apple App Store and Google Play Store.

→ Subscriptions auto-renew unless cancelled before the end of the current billing period.
→ Cancellation stops future renewals but does not provide a refund for the current billing period.
→ Premium benefits include: double daily CineManiac Score points, exclusive cosmetic shop items, and an ad-free experience.
→ Subscription pricing may change with reasonable notice.
→ Platform-specific refund policies (Apple / Google) apply for all transactions.
→ Billing issues may result in temporary suspension of premium features until resolved.

8 Virtual Currency & Shop

→ CineManiac Score points are a virtual currency with no real-world monetary value.

→ Points are earned through in-app activities: watching movies, rating films, adding friends, participating in events, daily login rewards, and watching rewarded video ads.

→ Points can be spent on virtual cosmetic items in the Shop (borders, text effects, color themes).

→ Virtual items have no real-world value and are non-transferable between accounts.

→ We reserve the right to modify point values, earning rates, and shop inventory at any time.

→ Points and virtual items are non-refundable.

9 Advertising

→ Non-premium users will see advertisements in the App, including banner ads, interstitial ads, and optional rewarded video ads.

→ Advertising is powered by Google AdMob.

→ You may opt out of personalized advertising via your device's advertising settings or via the App Tracking Transparency (ATT) prompt on iOS.

→ Rewarded video ads are entirely optional; watching them earns in-app CineManiac Score points.

10 Third-Party Services

The App integrates the following third-party services. Each is subject to its own terms.

11 Limitation of Liability

→ The App is provided "as is" without warranties of any kind, express or implied.

→ We do not guarantee uninterrupted availability or error-free operation of the App.

→ Movie and cinema data accuracy depends on TMDB and Google Places respectively; we are not responsible for inaccuracies in third-party data.

→ We are not liable for any loss of user data, ratings, social connections, or virtual items.

→ We are not liable for outages or errors caused by third-party services.

12 Termination

→ You may delete your account at any time from Settings → Account → Delete Account.

→ We reserve the right to suspend or permanently terminate accounts that violate these Terms, without prior notice.

→ Upon termination, your user data will be deleted in accordance with our Privacy Policy (please note the data retention gaps described therein).

13 Modifications to Terms

→ We may update these Terms at any time.

→ Material changes will be communicated to you via in-app notification or email.

→ Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

14 Governing Law & Dispute Resolution

These Terms are governed by the laws of Italy. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts of Italy, unless otherwise required by applicable consumer protection law in your country of residence.
